Please read these terms carefully before placing an order with East Ink Gallery.
1. About These Terms
These Terms & Conditions of Sale (“Terms”) apply to purchases made through East Ink Gallery (“East Ink Gallery”, “we”, “us” or “our”) at eastinkgallery.com.
The seller is Doveydovey Ltd, trading as East Ink Gallery. You can contact us at contact@eastinkgallery.com.
These Terms apply where you purchase as a consumer for personal use. If you are purchasing on behalf of a business, gallery, interior-design practice or other organisation, please contact us before placing your order.
By placing an order, you confirm that you are legally capable of entering into a binding contract and that the information you provide is accurate and complete.
2. Artwork Information & Availability
East Ink Gallery presents original artworks, limited editions and other art-related works as identified on the relevant product page. Each product page forms part of these Terms and provides the item-specific information that applies to your purchase, including the artist, medium, dimensions, edition information, framing options, condition, certificate details and availability.
Many artworks are unique or produced in limited quantities. Availability is subject to change, and an item may become unavailable before we are able to process your order. If this happens, we will notify you as soon as reasonably possible and refund any payment taken for the unavailable item.
We make reasonable efforts to display images, colours, materials and details accurately. However, colours may appear differently depending on your screen, device settings and lighting conditions. Handmade artworks may contain natural variations in texture, brushwork, ink, paper, surface, colour or finish. These characteristics are part of the nature of the work and are not defects where they are consistent with the product description.
Dimensions are approximate unless expressly stated otherwise. Please check the listed dimensions and framing details carefully before placing an order, particularly where the artwork is intended for a specific space.
Unless stated otherwise on the product page, copyright and all intellectual-property rights in the artwork remain with the artist and/or the relevant rights holder.
3. Prices, Taxes & Customs
All prices are shown in [CURRENCY]. The final price of your order, including any delivery charge and any taxes charged by us, will be shown at checkout before you submit payment.
We may change prices, delivery charges and promotions from time to time. Any change will not affect an order that we have already accepted.
For deliveries outside United Kingdom, local import duties, taxes, customs charges, brokerage fees or other charges may apply. Where these charges are not expressly included at checkout, they are the responsibility of the recipient. Customs requirements differ by destination and may cause delays outside our control.
Please check your local import rules before ordering. Refusal to pay customs charges, failure to provide information requested by customs, or failure to collect a parcel may result in the parcel being returned to us or treated as undeliverable. Any refund in these circumstances may be reduced by the reasonable costs we incur, where permitted by law.
4. Orders & Payment
When you place an order, you will receive an acknowledgement email confirming that we have received it. This acknowledgement does not mean that we have accepted your order.
A contract between you and East Ink Gallery is formed only when we send you an email confirming that your order has been accepted and/or dispatched. We may decline an order where an item is unavailable, payment has not been authorised, there is an obvious pricing or listing error, delivery is not reasonably possible, or we reasonably suspect fraud or unauthorised activity.
Payment must be made in full at the time of ordering using the payment methods made available at checkout. Payments are processed by our payment-service providers; we do not store your full payment-card details.
If we discover an obvious error in the price or description of an item after you have ordered it, we will contact you. You may choose to continue at the correct price or cancel the order for a full refund.
5. Delivery
We deliver to the destinations shown at checkout. Delivery estimates are provided in good faith but are estimates only, not guaranteed delivery dates. Dispatch and delivery may be affected by artwork preparation, framing, customs clearance, carrier delays, public holidays or events beyond our reasonable control.
Please ensure that your delivery address, contact details and any delivery instructions are correct before completing your order. We cannot accept responsibility for delay or loss caused by inaccurate information supplied by you.
Risk in the artwork passes to you when the parcel is delivered to the address you supplied, or when you or a person nominated by you takes possession of it. Ownership of the artwork passes only once we have received full payment.
Please inspect the parcel and artwork promptly after delivery. If the packaging is visibly damaged, please take photographs before opening it where possible and retain all packaging materials until the issue has been resolved.
Further delivery information is available in our Shipping & Delivery Policy.
6. Cancellations & Returns
If you are a consumer, you may have a legal right to cancel your order within 14 days after you, or a person nominated by you, receive the artwork. You do not need to give a reason for cancellation.
To exercise this right, please email us at [CONTACT EMAIL] with your order number, name and a clear statement that you wish to cancel. You may use the Model Cancellation Form below, but you are not required to do so.
Once you have told us that you wish to cancel, you must return the artwork to us without undue delay and no later than 14 days from the date you notify us. Unless the artwork is faulty, incorrect, damaged on arrival or otherwise not as described, you are responsible for the direct cost of returning it. We recommend using a tracked and appropriately insured service and retaining proof of postage.
We will refund the amount paid for the cancelled artwork and the cost of our standard delivery service, where applicable. We do not have to refund any additional cost resulting from your choice of an enhanced or express delivery option. We may withhold the refund until we receive the returned artwork or you provide evidence that you have sent it back, whichever happens first.
You are responsible for any reduction in the value of the artwork resulting from handling it beyond what is necessary to inspect its nature, characteristics and condition. Returned artworks must be securely packaged, preferably using the original packaging where reasonably possible.
The cancellation right does not apply to items made to your specifications or clearly personalised for you, including bespoke commissions where this has been clearly agreed before purchase. This does not affect your legal rights if an item is faulty, damaged, not as described or otherwise does not meet the required legal standard.
Our separate Returns & Refunds Policy explains the practical returns process. If there is any conflict between that policy and your statutory rights, your statutory rights will apply.
7. Damaged, Incorrect or Faulty Orders
If your artwork arrives damaged, is incorrect, is not as described, or appears faulty, please contact us as soon as reasonably possible at [CONTACT EMAIL]. To help us resolve the issue quickly, please include your order number, a description of the issue and clear photographs of the artwork, packaging and shipping label where relevant.
We ask that damage in transit is reported within 48 hours of delivery where possible. This request helps us make a claim with the carrier and does not limit your statutory rights.
Nothing in these Terms affects your legal rights. In particular, goods supplied to consumers must be as described, of satisfactory quality and fit for purpose. Where applicable, we will provide an appropriate remedy in accordance with the law, which may include a repair, replacement, partial refund or full refund.
8. Intellectual Property
All content on this website, including artwork images, photographs, text, design, logos and graphics, is owned by or licensed to East Ink Gallery, the relevant artist or other rights holder.
You may view and share website content for personal, non-commercial purposes only. You must not reproduce, copy, distribute, publish, alter, create derivative works from, use for commercial purposes, or otherwise exploit any artwork image or website content without prior written permission from the relevant rights holder.
Purchase of an artwork does not transfer copyright, reproduction rights, merchandising rights or any other intellectual-property rights in that artwork unless we expressly agree otherwise in writing.
9. Liability
We are responsible for losses that are a foreseeable result of our breach of these Terms or our failure to use reasonable care and skill. We are not responsible for losses that are not foreseeable, business losses suffered by consumers, or losses caused by events outside our reasonable control.
Nothing in these Terms limits or excludes liability where it would be unlawful to do so, including liability for fraud or fraudulent misrepresentation, death or personal injury caused by negligence, or your statutory consumer rights.
10. Contact, Complaints & Governing Law
If you have a question, concern or complaint, please contact us first at contact@eastinkgallery.com. Please include your name, order number and a clear description of the issue so that we can respond efficiently.
These Terms are governed by the law of England and Wales. If you are a consumer resident outside England and Wales, you may also benefit from mandatory consumer-protection provisions in your country of residence where applicable.
If any part of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in effect.
